These Terms and Conditions govern access to the Pallet Town website and the purchase of liquidation pallets, wholesale lots, customer returns, overstock merchandise and related products or services. Please read them carefully before using our website or placing an order.

Consumer Rights

Nothing in these terms excludes rights that cannot lawfully be excluded under Australian Consumer Law.

Australian Consumer Law applies where required.

These terms must be read subject to the Competition and Consumer Act 2010, including the Australian Consumer Law, and any other rights or remedies that cannot legally be excluded, restricted or modified.

Acceptance of These Terms

By accessing or using this website, creating an account, requesting a quotation, placing an order or purchasing goods from Pallet Town PTY LTD, you agree to be bound by these Terms and Conditions.

If you do not agree with these terms, you should not place an order or continue to use website functions that require acceptance.

These terms apply together with our Privacy Policy, Shipping Policy, Payment Policy, Returns and Refunds Policy, product listings, quotations, invoices and any other written terms specifically agreed for an order.

Where there is an inconsistency, a specifically negotiated written agreement for an individual order takes priority over these general terms, followed by the relevant quotation or invoice, product listing and then these website terms.

Eligibility and Authority

You must be at least 18 years old and legally capable of entering into a binding contract to place an order.

If you place an order on behalf of a company, partnership, trust or other organisation, you represent that you have authority to bind that entity to these terms.

You must provide complete, current and accurate customer, billing, payment and delivery information. You must promptly correct any information that becomes inaccurate.

Website Information

We aim to keep website information accurate and current. However, product availability, photographs, descriptions, prices, freight estimates and other content may occasionally contain errors or become outdated.

General website content is provided for information and does not constitute professional, financial, legal or resale advice. Customers should make their own commercial assessment before purchasing liquidation inventory.

Product images may include stock images, supplier photographs or images of representative stock. Where an image shows the exact pallet or lot being sold, the listing should expressly state that it is the exact product.

Screen settings, lighting and photography may cause colours or appearances to vary. Such minor visual differences do not override any accurate written description or statutory rights.

Nature of Liquidation Products

Pallet Town sells liquidation and wholesale inventory that may include customer returns, overstock, shelf-pulls, ex-display items, excess stock, discontinued products, damaged packaging, mixed merchandise and other secondary-market goods.

Customer Returns May be opened, used, incomplete, cosmetically marked, untested, repaired or non-working.
Overstock May be new or unused but could show packaging, handling, storage or label wear.
Shelf-Pulls May have price labels, packaging changes, display wear or cosmetic imperfections.
Mixed Merchandise May include different brands, categories, models, conditions and quantities in one lot.
Manifested Lots Include an item list where available, subject to any specifically disclosed manifest qualifications.
Unmanifested Lots Exact contents, quantities, brands and conditions may be unknown unless expressly stated.

Customers must carefully review the product title, description, photographs, grade, condition notes, manifest and stated exclusions before ordering.

A disclosed defect or condition issue will generally not provide a basis for complaint solely because that disclosed issue is present. This does not affect rights concerning an undisclosed or separate failure covered by law.

Product Listings and Availability

All products are subject to availability. Liquidation inventory is often limited, unique or sold in low quantities and may become unavailable without notice.

Adding a product to a cart does not reserve it. Stock is not secured until the order is accepted and any required payment has been received.

We may set reasonable minimum or maximum order quantities and may limit quantities where necessary to manage stock fairly, prevent fraud or correct an obvious website error.

Product titles, categories and estimated retail values are provided to help customers assess a listing. Unless expressly guaranteed in writing, an estimated original retail value is not a guarantee of current market value, product condition, resale price, demand or profit.

Orders and Contract Formation

An order submitted through our website is an offer by the customer to purchase the selected goods under these terms.

An automated order-received email confirms that we have received the request but does not necessarily mean that the order has been accepted.

A binding sales contract is formed when we issue an order confirmation or invoice accepting the order and receive any payment required before fulfilment.

Before accepting an order, we may reasonably:

  • confirm stock availability
  • verify customer, delivery and payment details
  • review possible fraud or security risks
  • confirm delivery access and freight requirements
  • request further information about a high-value order
  • correct an obvious pricing, quantity or listing error

If we cannot accept an order, we will notify the customer and return any amount paid for that order using the original payment method or another agreed lawful method.

Pricing and Charges

Prices are displayed in Australian dollars unless otherwise stated.

The checkout page, quotation or invoice will identify whether delivery, freight, handling, insurance, installation or other charges are included or charged separately.

Customers should rely on the final checkout total, quotation or invoice rather than a price viewed on an earlier page. All applicable product, delivery, freight, handling and other agreed charges will be disclosed before payment.

We may change website prices prospectively at any time. A price change will not alter an order that has already been accepted unless the customer agrees or correction is otherwise permitted by law.

Obvious pricing errors

If a product is displayed at an obviously incorrect price due to a typographical, system, supplier or calculation error, we may correct the error before accepting the order.

Where payment has already been received for an unaccepted order, the customer may choose to proceed at the corrected price or receive a full refund.

Payments

Customers must pay using an approved payment method shown at checkout or stated on an authorised Pallet Town invoice.

Payment must be received in cleared funds by the stated due date. An order may be placed on hold or cancelled if payment is not received by that date.

Customers are responsible for checking that bank details and payment instructions were received through an authorised Pallet Town channel before transferring funds.

Payment security warning

Pallet Town will not ask customers to provide online-banking passwords, complete card-security codes or account login credentials by email. Contact us directly if payment instructions appear unusual or change unexpectedly.

We may use external payment providers. Their terms and privacy policies may also apply to payment processing.

The customer must pay any bank fees or transaction costs imposed by the customer’s own financial institution. Any card surcharge or payment fee charged by us will be disclosed before payment and applied only where lawful.

Ownership, Title and Risk

Legal title to goods remains with Pallet Town until the purchase price and all agreed charges for the goods have been paid in cleared funds.

For delivery arranged by Pallet Town, risk ordinarily transfers to the customer when the goods are delivered to the agreed delivery location.

For customer collection or transport arranged independently by the customer, risk ordinarily transfers when the goods are collected by the customer or the customer’s nominated carrier.

Nothing in this clause limits responsibility for damage caused by Pallet Town, its contracted delivery provider or any rights that cannot be excluded by law.

Delivery, Freight and Collection

Delivery dates and timeframes are estimates unless expressly confirmed as a binding commitment in writing.

Delivery may be affected by product availability, depot schedules, carrier capacity, weather, road conditions, regional access, public holidays and other matters outside reasonable control.

Customers must provide an accurate delivery address, contact number and any site information reasonably required for safe delivery.

Delivery is complete when the goods are unloaded at the agreed accessible location or made available for collection as agreed.

If nobody is available to accept delivery, or delivery cannot be completed due to inaccurate information or unsuitable access, reasonable redelivery, waiting, storage or carrier charges may apply where those charges are properly incurred and permitted by law.

Separate delivery arrangements may apply to remote areas, islands, restricted-access locations or unusually large orders.

Delivery-Site Access and Customer Responsibilities

The customer must ensure the delivery location is safe, accessible and suitable for the vehicle and unloading method communicated before delivery.

The customer must disclose relevant conditions, including:

  • narrow roads, gates, driveways or turning areas
  • soft, unstable, steep or unsealed ground
  • low bridges, trees, powerlines or overhead obstructions
  • weight, height, time or vehicle restrictions
  • site inductions, bookings or access permits
  • crane, forklift or specialised unloading requirements

The driver may refuse to enter or unload at a location reasonably considered unsafe. In that event, the parties will discuss a safe alternative location or redelivery arrangement.

The customer is responsible for obtaining any permissions needed for delivery, storage or use of the goods at the destination.

Inspection and Reporting Problems

Customers should inspect the outer wrapping, pallet count and visible condition of the goods as soon as reasonably practicable after delivery.

Any visible transit damage or shortage should be photographed and reported promptly with the order number, delivery date and relevant evidence.

Prompt reporting assists with carrier claims and investigation, but does not remove any statutory right that may apply after a longer period.

Customers should retain packaging, manifests and affected goods until Pallet Town provides instructions.

Returns, Refunds and Change of Mind

Eligible change-of-mind return requests may be submitted within 30 calendar days after delivery or collection, subject to the conditions in our Returns and Refunds Policy.

Approved refunds will be processed as soon as reasonably practicable and within no more than 14 business days after approval and satisfaction of any required return conditions.

Change-of-mind returns generally require the lot to remain complete, materially unaltered and in substantially the same condition as supplied. The customer is ordinarily responsible for change-of-mind return freight.

The voluntary 30-day period does not limit Australian Consumer Law rights concerning faulty, unsafe, misdescribed or otherwise non-compliant goods.

Australian Consumer Law and Consumer Guarantees

The remedy available depends on the circumstances and whether the failure is major or minor.

For a major failure, an eligible consumer may generally reject the goods and choose a refund or replacement, subject to the Australian Consumer Law.

For a minor failure, Pallet Town may choose to repair the goods, replace affected goods or provide another appropriate remedy within a reasonable time.

If a minor failure is not remedied within a reasonable time, further remedies may become available.

Consumer guarantees may also apply to some purchases made by businesses. Their application depends on the price, nature and intended use of the goods and whether the goods were acquired for resupply or transformation.

Nothing in these terms excludes, restricts or modifies a guarantee, right, remedy or liability that cannot legally be excluded, restricted or modified.

Order Cancellations

Cancellation by the customer

Contact us promptly if you wish to cancel an order. An order that has not been allocated, prepared, dispatched or committed to a freight provider may ordinarily be cancelled and refunded.

If the order has already been dispatched, specially prepared or booked with a carrier, reasonable non-recoverable costs may apply to a voluntary cancellation where those costs were disclosed, properly incurred and lawful.

Cancellation by Pallet Town

We may cancel an unfulfilled order where:

  • the product is unavailable
  • payment has not been received
  • delivery cannot be completed safely or lawfully
  • the order appears fraudulent or unauthorised
  • there is an obvious listing or pricing error
  • fulfilment would breach a legal or regulatory requirement

If we cancel an order after receiving payment, we will refund the amount paid for the cancelled goods and any unprovided service, unless another arrangement is agreed.

Customer Accounts

You are responsible for maintaining the confidentiality of your login details and for activity conducted through your account.

You must notify us promptly if you suspect unauthorised access, fraudulent activity or compromise of your account credentials.

You must not create an account using false information, impersonate another person or use another customer’s account without authorisation.

We may request identity or business verification where reasonably necessary to protect customers, prevent fraud or meet legal obligations.

Customer Reviews and Submitted Content

Customers may be permitted to submit product reviews, photographs, questions, comments or other content.

Submitted content must be honest, based on genuine experience and must not be unlawful, threatening, discriminatory, defamatory, misleading, fraudulent, obscene or infringe another person’s rights.

You retain ownership of original content you submit. By submitting content for publication, you grant Pallet Town a non-exclusive, royalty-free licence to display, reproduce and format that content for website, customer-service and promotional purposes.

We may moderate or remove content where reasonably necessary for legal, security or platform-integrity reasons. We will not suppress genuine negative feedback merely because it is critical.

Pallet Town does not authorise fabricated customer reviews, misleading ratings or testimonials attributed to people who did not provide them.

Acceptable Website Use

You must not use the website to:

  • commit fraud or engage in unlawful activity
  • upload malicious code, malware or harmful material
  • attempt unauthorised access to accounts or systems
  • interfere with website security or availability
  • scrape or extract content using unreasonable automated means
  • misrepresent identity, authority or payment information
  • infringe intellectual-property or privacy rights
  • send unsolicited advertising through website functions
  • place false, speculative or abusive orders
  • use the website in a way that harms another person

Reasonable indexing by legitimate search engines and ordinary customer browsing are not prohibited by this clause.

Intellectual Property

Unless otherwise stated, the website design, branding, logos, written content, graphics, icons, product presentation, software and other original materials are owned by or licensed to Pallet Town.

You may view and print reasonable extracts for personal or internal business purchasing purposes.

You must not reproduce, republish, sell, modify, distribute, frame, mirror or commercially exploit protected website content without written permission, except as permitted by law.

Third-party product names, images, brands and trademarks remain the property of their respective owners. Their appearance does not imply sponsorship or endorsement unless expressly stated.

Third-Party Services and Links

The website may connect to payment gateways, shipping providers, analytics platforms, social networks or other external services.

Third-party services may have separate terms and privacy policies. Customers should review those terms before using the relevant service.

A link to an external website does not necessarily mean Pallet Town endorses or controls that website.

Nothing in this clause excludes responsibility where Pallet Town is legally responsible for the conduct of a contractor or service provider.

Marketing Communications

We may send promotional emails or SMS messages only where we have consent or another lawful basis.

Commercial electronic messages will identify the sender and include a functional unsubscribe method as required by law.

Customers may opt out by using the unsubscribe facility or contacting sales@pallettownpytltdau.com.

Opting out of marketing will not prevent necessary order, payment, delivery, account-security or customer-service messages.

Liability and Disclaimer

Nothing in these terms excludes or limits liability that cannot lawfully be excluded or limited.

To the maximum extent permitted by law, Pallet Town does not guarantee:

  • a particular resale price, margin or profit
  • that every item within a mixed or untested lot will work
  • continuous or error-free website availability
  • that third-party websites or services will remain available
  • future market demand for liquidation products
  • compatibility with a customer’s intended resale platform

Where liability can lawfully be limited, Pallet Town’s liability will be limited to the extent reasonable in the circumstances, having regard to applicable law, the nature of the loss and the goods or services supplied.

We are not responsible for loss caused solely by a customer’s misuse, unauthorised repair, improper storage, failure to follow safety instructions, inaccurate delivery information or unreasonable failure to mitigate loss.

Any limitation in these terms must be read down or severed to the extent necessary to comply with the law.

Customer Indemnity

To the extent permitted by law, you agree to compensate Pallet Town for reasonable loss, damage or expense directly resulting from:

  • your unlawful use of the website
  • fraudulent information or payment activity
  • your infringement of another person’s rights
  • content you submit in breach of these terms
  • a material breach of these terms caused by your conduct

This indemnity does not apply to the extent that loss was caused or contributed to by Pallet Town, its employees, contractors or any matter for which liability cannot lawfully be excluded.

Events Beyond Reasonable Control

A party will not be liable for delay or failure caused by an event outside its reasonable control, such as severe weather, natural disaster, fire, flood, road closure, industrial dispute, transport interruption, government restriction, cyberattack, utility failure or supplier disruption.

The affected party must take reasonable steps to reduce the effect of the event and resume performance when practicable.

Customers will be informed of a material delay. If performance becomes impossible or is delayed for an unreasonable period, either party may be entitled to cancel the affected portion of the order and receive any refund required by law.

Account or Website Suspension

We may temporarily restrict access to an account or website function where reasonably necessary to investigate suspected fraud, security threats, unlawful conduct or material breach of these terms.

Where appropriate, we will notify the affected customer and provide a reasonable opportunity to address the issue.

Suspension will not remove obligations relating to accepted orders, payments, refunds or consumer guarantees.

Complaints and Dispute Resolution

Contact us first if you have a concern about an order, product, payment, delivery or these terms.

Include your name, order number, relevant dates, a description of the issue, supporting evidence and your preferred resolution.

Both parties will attempt to resolve the matter in good faith.

If unresolved, either party may use an external dispute body, consumer agency, tribunal, mediation or court process.

Nothing in this clause prevents a customer from contacting the Australian Competition and Consumer Commission, the Queensland Office of Fair Trading, another consumer-protection body or a court or tribunal with jurisdiction.

Changes to These Terms

We may update these terms to reflect changes to our website, products, practices, service providers or legal obligations.

Updated terms will be published with a revised effective date and will apply prospectively.

A material change will not retrospectively alter an accepted order unless required by law or agreed by the customer.

Customers should review the terms applicable at the time of each order.

General Legal Terms

Governing law

These terms are governed by the laws of Queensland, Australia, and applicable Commonwealth laws.

Subject to any right to commence proceedings elsewhere under applicable consumer law, the parties submit to the jurisdiction of courts and tribunals in Queensland.

Severability

If a term is invalid, unlawful or unenforceable, it will be read down to the minimum extent necessary. If it cannot be read down, it will be severed without affecting the remaining terms.

No waiver

A delay or failure to enforce a right does not waive that right. A waiver must be clear and applies only to the particular matter for which it was given.

Assignment

A customer may not transfer an accepted order or contractual right without our written consent, which will not be unreasonably withheld where the transfer does not prejudice fulfilment or legal compliance.

Pallet Town may transfer its rights and obligations as part of a genuine sale, restructure or transfer of the business, provided that the transfer does not reduce a customer’s existing rights.

Entire agreement

These terms and the documents incorporated into them record the agreement concerning website use and purchases, except for representations or rights that cannot legally be excluded.

Electronic communications

You agree that orders, notices, invoices, confirmations and other communications may be provided electronically, subject to applicable law.
